WHEN USING THE QUAQUA PLATFORM, DUVALL MAY PROCESS PERSONAL DATA ON USERS BEHALF. PLEASE READ THE FOLLOWING CAREFULLY TO UNDERSTAND OUR VIEWS AND PRACTICES REGARDING YOUR PERSONAL DATA AND HOW WE WILL TREAT IT. IF, AND TO THE EXTENT, DUVALL PROCESSES ANY PERSONAL DATA OF THIRD PARTIES ON THE USERS BEHALF WHEN RENDERING THE SERVICES, DUVALL AND USER RECORD THEIR INTENTION THAT, RELATING TO THE PROCESSING OF THE PERSONAL DATA OF THESE THIRD PARTIES, USER SHALL BE THE DATA CONTROLLER AND DUVALL SHALL BE A MERE DATA PROCESSOR.

1. Description of the QUAQUA PLATFORM

Within DUVALL an online meeting platform with remote interpreting and translation has been developed that enables Users to start or engage in an online conference and therein share, send, receive, translate, synchronize, integrate, consolidate, process and link data spoken or written upon acceptance of the Terms of Use QUAQUA Platform (“Agreement”) and as far as the Users have complied with all obligations either listed in this Agreement or explicitly mentioned in the order process.

2. Definitions

2.1. “DUVALL”: DUVALL BVBA with enterprise number BE 0452.726.318 and registered office at Ambachtsweg 22, B- 9820 Merelbeke, Belgium.
2.2. “Interpreter”: a service provider and User which receives User Content (visual, written or audible) and translates this User Content to forward the translation of the User Content to another User, all by using the QUAQUA Platform;
2.3. “Personal Data”: any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
2.4. “QUAQUA Platform”: the online meeting platform with remote interpreting and translation developed by DUVALL that enables Users to start or engage in structured communication;
2.5. “User”: “any existing person (adult), whether using the QUAQUA Platform as meeting organiser, participant or Interpreter on its own account or on account of its company that intends to use the QUAQUA Platform for its legitimate commercial purposes;
2.6. “User Content”: all information and data provided by the User through the QUAQUA Platform;
2.7. “Website”: The Website through which DUVALL offers its services online, currently https://duvall.be/nl/ or any successor or URL indicated by DUVALL from time to time.

3. Data

3.1. In order to allow User to use the QUAQUA Platform, DUVALL processes Personal Data received from the User, this includes Personal Data of the User. The following Personal Data may be processed:
3.1.1. Information that the User provides by filling in the contact form on the Website, namely, name, company name, e-mail, telephone number and Personal Data included in the message;
3.1.2. Information provided at the time of registering to use the QUAQUA Platform, namely first name, family name, function, company name, address, e-mail address, phone number;
3.1.3. Communication and correspondence with the User and User contact details;
3.1.4. Information that User uploads to, or chooses to share (visual, written or audible) and, with other Users or Interpreters by using the QUAQUA Platform;
3.1.5. Details of User visits to the Website and User Platform including, but not limited to, traffic data, location data and other communication data and the resources that User accesses.
3.2. If information is provided by a User via a form, the fields indicated with a (*) strictly are necessary for the purposes for which they are processed. If these are not filled in, the submission of the form will not be followed.

4. IP addresses and cookies

4.1. DUVALL may collect information about Users computer, including where available your IP address, operating system and browser type, for system administration and to report aggregated information to User. This is statistical data about Users’ browsing actions and patterns and does not identify any individual.
4.2. For the same reason, DUVALL may obtain information about Users general internet usage by using a cookie file which is stored on the hard drive of Users computer. Cookies contain information that is transferred to Users computer’s hard drive. They help DUVALL to improve the Website and to deliver a better and personalised Service.
4.3. User may refuse to accept cookies by activating the setting on Users browser which allows User to refuse the setting of cookies. However, if User selects this setting User may be unable to access certain parts of the Website. Unless User has adjusted the browser setting so that it will refuse cookies, the system will issue cookies when User logs on to the Website.

5. Purpose

5.1. DUVALL processes Personal Data on the instructions of User. Therefor User shall ensure that it is entitled to transfer the relevant Personal Data to DUVALL, so that DUVALL may lawfully use, process, store and transfer the Personal Data for the purposes of rendering the Services.
5.2. DUVALL processes Personal Data to carry out the agreement between DUVALL. The Personal Data are used to:
5.2.1. Execute and offer use of the QUAQUA Platform;
5.2.2. Ensure any content is presented in the most effective manner for the User and User’s hardware;
5.2.3. Allow Users to share, send, receive, translate, alter, synchronize, integrate, consolidate, process and link data to other Users;
5.2.4. Manage the requests for information;
5.2.5. Improve the operation of the Website and the QUAQUA Platform;
5.2.6. Perform account administration;
5.2.7. Comply with applicable law;
5.2.8. Notify User on the changes to the QUAQUA Platform.
5.3. If the processing of Personal Data is based on the User’s consent, User has the right to withdraw the consent at any time, without this affecting the legality of the processing on the basis of the permission before its withdrawal.
5.4. Improving the operation of DUVALL is to the benefit of the Users, there is no harm to the rights and interests of involved Users.

6. Disclosure of your information

6.1. DUVALL does not sell or rent the Personal Data to third parties.
6.2. Within DUVALL, Personal Data are only made available to its staff on a need-to-know basis.
6.3. DUVALL may use sub-processors to process Personal Data of the User.
6.4. DUVALL may disclose or share User’s Personal Data when required by law, or to enforce or apply DUVALL’s Terms of Use; protect DUVALL’s rights, property and safety. This includes exchanging information with third party companies and organisations for the purposes of fraud protection and credit risk reduction.
6.5. DUVALL can change its corporate structure by changing its legal form, merger, acquisitions and sales. In such transactions, Personal Data may be transmitted in accordance with this Privacy Statement and the applicable data protection legislation.

7. Storage and retention of Personal Data

7.1. The Personal Data that DUVALL collects from User is stored on information technology systems located in the European Union which are operated by DUVALL.
7.2. Although DUVALL gives its best effort in protecting User’s Personal Data, DUVALL cannot guarantee the total security of Personal Data and any transmission is at User’s risk.
7.3. DUVALL takes appropriate technical and organisational measures to prevent unauthorised access to the Personal Data received.
7.4. Upon instructions of the User and at the end of the Service, DUVALL will delete all Personal Data.

8. Aggregated statistics

8.1. DUVALL may collect statistics about the behaviour of visitors and Users of the Website and QUAQUA Platform. For instance, DUVALL may monitor amongst others the most popular parts of a site, the most viewed video content or the most read articles.
8.2. DUVALL may display this information publicly or provide its Users or third parties. However, these data are ammonized and therefore not considered Personal Data.

9. User rights

9.1. Users have the right to request to review, rectify or erase Personal Data or to limit the processing of their Personal Data, as well as the right to objection to processing of the Personal Data and the right to request data transferability.

10. Changes to our privacy policy

10.1. DUVALL has the right to make changes to this Privacy Policy.
10.2. Any changes DUVALL may make to the Privacy Policy in the future will be posted on this page and, where appropriate, notified to you by email.
